have been off with a personal injury, not job related , but dr. says no lifting until dec. 12th , work at abf phoenix, can i come back as light duty even tho its not industrial ? until 12/12/11
The company does not have to offer light duty for employees injured off the job. However, if they offer light duty work for those who are injured on the job but will not offer it to you, then you can collect unemployment.
Not if you are unable to perform the work that is offered. If you can not do the job you can not collect unemployment. I broke my leg and was unable to walk up the stairs for work so was unable to come back to work until I had a walking cast. The only thing I could get was temporary disability thru ssi and the union.
Yes, first you need a release for work from your doctor. However, if there was a prior case similar to yours and the company accommodated that individual they should also accommodate you. It never hurts to make your argument before the unemployment judge.
