I know that around here upper management has been pressuring local management to give letters out for not taking/logging breaks.
Heard of a story at another terminal of a guy who got a letter for not hanging up a broom that he set down for a minute.
Any other stories out there?
I hope this isn't them going all roadway on us.

I always log and take my breaks and have not heard of any discipline on it for anyone else myself. Putting a broom down anywhere, for a short term or long term sounds chicken **** to me and I would say that if it happened it's a BM out of control

here in phx, about 16 of us recv. letters on same day for not logging breaks, i did not take last breaks on two differnt days , needed to get off asap, got two letters , so i gave them 20 min. for free ,and i get a letter . no more , my breaks come before freight now , i've always put customers first for last 20 years ,hard to change old habits but thats how abf wants it.

And a tip for all of us. If you get that break in early they can't tell you to use it up when you get held up somewhere.

They told us that it makes the numbers better if you take a your breaks. That time comes out of the production for the day. I say if ten minutes is good then 15 has to be better.

Mgt has been hammering home the point of logging your breaks and your 30 minute lunch for DOT accountability. Our browsers are crap and usually last only a few hours into a shift, then they complain I don't log, but it's on the paper manifest. After running all day, the last thing I want to do after hitting a door, is finding a working browser and go back and log all my stops, break, etc. what a PITA.

30 minute lunch break could be a DOT requirement but the 10 minute breaks are not. I have heard buzz that city drivers don't fall under the DOT requirement but who wants to work all that time without eating lunch? I recommend everyone take your breaks as agreed upon, log them if you can and putting them on the paper manifest should be enough if you can't do it on a browser. Don't UE's use paper logs? You can show your breaks on that if you do.

Aren't we all (except the UEs) running the PDAs at this point? And don't we all have cigarette lighter chargers for them?

I am a city driver. Yes, I have the power cord. We seem to have drivers who can't comprehend how to properly disconnect a cord. They borrow my PDA and return it with the connection pins bent, thus no charge feature.this will be the third time in for repair. I go through two batteries a day at the minimum. And man don't take another assigned PDA on the street with you. Just a side note, I take my 30 wether busy or not. If you do more than 12 hrs in a day, you have to log a 30 in your first 8 or your in violation. Now, you can roll the dice and see if dispatch will get you out before that. If not, and you didn't log within your first 8, you're in violation.

Sounds like a design flaw to me. Those PDA's don't seem to be all that dependable to me. I often have problems and have to reboot the screen and the unit to get it to work.

FMCSA has stopped enforcement of the 30 min break by short haul drivers.
A court decision has prompted them to change their tune on this issue
It is on their web site under new provisions Down load that and stick it under your TMs nose.
I still would not give the pricks 1 minute of free labor. .

In my career, I was advised early on by my first BA to immediately send a protest letter to the hall along with a copy of any disciplinary letter I received, regardless if I felt I deserved it or not. They would write back and respectfully request the disciplinary action be removed from my file. At least, we had a protest on file, especially if it was a petty issue. None of mine were ever petty....but, none real serious....I'll claim the 5th at this point...and no letters since I've been at ABF...a couple of verbals, that I needed, but done respectfully...

They'll all be paperless soon so if you want anything to show off you better get yourself one now.

Well, I recently saw a guy put back on that was fired after a 2 week suspension. Totaled out a tractor and a set, but no other vehicles involved and no serious injuries. Termination was handed down from the Fort, TM was just the messenger. However, protest letter got him back on. I also have a good friend who was a 23 year veteran with Southeastern (non-Union) in similar situation, no other vehicles, he did suffer a broken collar bone. But when he healed, and the doctor released him to return to work, they fired him. He appealed to the home office to no avail, and his attorney said he had no legal case in Alabama they were allowed to fire him without recourse because his actions were less than "professional" and CDL holders in Alabama are considered professionals and are expected to perform as such. So, the old Union still has some clout.

You are much more likely to win a fight with somebody standing in your corner with you. At some point in your working career you are going to make an honest mistake. It is good to know you can call the hall & have representation. I have never had a problem with paying dues.

Residential delivery was being made driver hit tree branch at the residence, air deflector was cracked & driver was disciplined with a chargeable accident. The reason he was charged was he pulled over to far so traffic was able to get thru, labor man b.a. & steward had a meeting the letter stuck. If this is not taken care of we will not be doing residentials unless it's wide open or they meet us in a parking lot or dock p/ up.I always thought it was the towns responsibility to take care or the trees just like the utility company's are responsible for the wires being 14 feet high....

Doesn't sound like we work for the same company here. You should look at our fleet, one looks like it was last truck standing at the demolition derby. Wind deflector? You mean wire and limb deflector, don't you? Just tell them that the wind did it, or maybe that only works if you're numba one ballwasher. The only choice you have when this goes on is like you say. Can't go there because...Do I have permission? There has to be more to the story for the labor ******* to get involved in it. Doesn't there?

ya they had other grievances file for freight value taking our freight, the tree incident happened the day before. Lost everyone ....

Sounds like retaliation for filing grievances to me. This is where keeping records over a long period of time is important.
